As of September 22, 2002, the Industrial Property Office accepts color mark applications. Applicants must clearly state the claimed colors, as they desire. The Office does not require certain specific standards and mere description of the claimed colors is sufficient. The Office classifies color marks according to the International Classification of the Figurative Elements of Marks.Since the trademark gazette does not publish the marks in color, the claimed colors are mentioned in the advertisements and a colored sample of the marks is available at the Office for public reference.According to the new procedure, colors per se are not registrable but single or multi color trademarks may be registered. Color trademark applications are subject to examination as to distinctiveness and non-functionality. Requirements for the filing of a color mark are:
- Full name and address of the applicant.
- List of goods and services and related classes.
- Twelve samples of the mark in color.
- Certified and legalized Power of Attorney up to the Iranian consulate.
- Certified copy of home or foreign registration or application.
