| NOKIA takes care of its well-known mark | November 11, 2004 | Mr. Kazem Rahimzadeh, an Iranian individual, filed an application to register NOKIAN in Farsi covering goods in international class 12 in Iran.
Nokia Corporation opposed the application claiming confusing similarity with its famous mark NOKIA registered in classes 9 and 35 in Iran and also to strengthen the opposition and meet the legal requirements, Nokia filed a new application for NOKIA in class 12. Nokia also claimed that use of the mark NOKIAN will mislead the average consumers as to source of goods.
Mr. Kazem Rahimzadeh argued that the mark NOKIAN is in Farsi and has no similarity in appearance with the mark NOKIA.
The court ruled for the cancellation of the NOKIAN application based on the prior worldwide use of the mark NOKIA by NOKIA Corporation. The court held that use of the mark NOKIAN by the Iranian applicant is an unfair competition issue.
