VOV & VO5 held not to be confusingly similar December 22, 2003
In VOV Cosmetics Co. vs. Trademark Office, the court reversed the decision of the Trademark Office for the rejection of the application for the VOV trademark.
VOV Cosmetics Co. Ltd., Korean cosmetics manufacturer, filed an application for the registration of the trademark VOV in class 3. The Trademark Office found that the trademark is substantially similar to the registered trademark VO5 in classes 3 and 5 by Alberto-Culver Company, a US company, and rejected the VOV application.
The VOV Cosmetics Co. Ltd. filed an appeal. The court reversed the decision of the Trademark Office holding that the marks were sufficiently distinctive in pronunciation and writing and were not sufficiently similar that consumers might be misled as to the origin of the products.
